1. Taraflar ve Kapsam

Bu Şartlar ve Koşullar (“Şartlar”), Özgür Demir (“Vamos Dans”, “biz”, “bize” veya “bizim”) ile vamosdans.com web sitesini (“Web Sitesi”) ziyaret eden veya Web Sitesi üzerinden sunulan hizmetlerden yararlanan kişi (“Kullanıcı”, “siz”) arasındaki kullanım koşullarını düzenler.

Web Sitesi üzerinden sunulan hizmetler arasında Argentine Tango grup dersleri, özel dersler, online özel dersler, workshoplar, etkinlikler ve gelecekte sunulabilecek tango eğitimleri, retreatler, maratonlar ve benzeri hizmetler yer alabilir.

Web Sitesini kullanarak, rezervasyon veya satın alma işlemi gerçekleştirerek bu Şartları okuduğunuzu ve kabul ettiğinizi beyan etmiş olursunuz.

2. Hizmetler

Vamos Dans, Web Sitesi üzerinden ve/veya Web Sitesinde belirtilen fiziksel veya online kanallar aracılığıyla Argentine Tango eğitim ve etkinlik hizmetleri sunmaktadır.

Hizmetlerin içeriği, tarihi, süresi, yeri, eğitmeni, kontenjanı ve ücreti ilgili hizmetin rezervasyon veya tanıtım sayfasında belirtilir.

Vamos Dans, gerekli gördüğü durumlarda ders, workshop veya etkinlik programlarında makul değişiklikler yapabilir. Önemli değişiklikler olması halinde, mümkün olduğu ölçüde katılımcılara önceden bilgi verilir.

3. Rezervasyon ve Kayıt

Bir hizmet için rezervasyon veya kayıt yaptığınızda, verdiğiniz bilgilerin doğru, güncel ve eksiksiz olduğunu kabul edersiniz.

Rezervasyonun tamamlanması, ilgili hizmet için belirtilen şartlara ve ödeme koşullarına bağlıdır.

Bir hizmetin kontenjanla sınırlı olması halinde, kayıt ancak rezervasyonun ve gerekli ödemenin tamamlanmasıyla kesinleşebilir.

Vamos Dans, yasal yükümlülükler ve hizmetin niteliği çerçevesinde, kapasite veya organizasyonel nedenlerle bir rezervasyonu kabul etmeme hakkını saklı tutabilir.

4. Ücretler ve Ödemeler

Her hizmet için geçerli ücret, ödeme koşulları ve varsa vergiler, rezervasyon veya satın alma işlemi sırasında kullanıcıya açıkça gösterilir.

Ödeme işlemleri, Web Sitesinde sunulan veya ilgili hizmet için belirtilen ödeme yöntemleri aracılığıyla gerçekleştirilir.

Bir hizmetin fiyatında değişiklik yapılması halinde, daha önce tamamlanmış ve onaylanmış rezervasyonlar için uygulanacak fiyat, ilgili rezervasyon sırasında kullanıcıya bildirilen şartlara göre belirlenir.

Ödeme ve faturalandırma işlemlerinde kullanıcı tarafından sağlanan bilgilerin doğruluğundan kullanıcı sorumludur.

5. Ders, Workshop ve Etkinlik Katılımı

Kullanıcı, kayıt olduğu ders, workshop veya etkinliğin tarih ve saatine uygun şekilde katılım göstermekle yükümlüdür.

Kullanıcının geç kalması, katılmaması veya gerekli bildirimde bulunmadan rezervasyonunu kullanmaması halinde, ilgili hizmetin niteliğine ve rezervasyon koşullarına göre hizmetin telafisi veya ücret iadesi mümkün olmayabilir.

İptal, değişiklik ve iade koşulları ayrıca Geri Ödeme ve İptal Politikası kapsamında düzenlenmiştir.

6. Online Dersler

Online özel dersler, rezervasyon sırasında belirtilen platform veya iletişim yöntemi üzerinden canlı olarak gerçekleştirilir.

Kullanıcının online derse katılabilmesi için gerekli internet bağlantısı, cihaz, kamera, mikrofon ve benzeri teknik ekipmanların uygun şekilde çalışmasını sağlamak kullanıcının sorumluluğundadır.

Kullanıcının teknik nedenlerle derse katılamaması durumunda uygulanacak koşullar, ilgili hizmetin rezervasyon şartlarına ve Geri Ödeme ve İptal Politikası'na göre değerlendirilir.

7. Kullanıcı Davranışı

Web Sitesini ve Vamos Dans hizmetlerini kullanırken yürürlükteki tüm yasalara ve üçüncü kişilerin haklarına uymayı kabul edersiniz.

Aşağıdaki davranışlarda bulunmanız yasaktır:

Web Sitesini hukuka aykırı amaçlarla kullanmak,
Başka kişilerin kişisel bilgilerini izinsiz şekilde toplamak veya kullanmak,
Web Sitesinin güvenliğini veya teknik işleyişini bozmak,
Virüs, zararlı yazılım veya benzeri kodlar göndermek,
Web Sitesindeki içerikleri izinsiz şekilde kopyalamak veya dağıtmak,
Başka kişileri taciz etmek, tehdit etmek veya rahatsız etmek,
Yanlış, yanıltıcı veya sahte bilgiler vermek,
Vamos Dans'ın veya üçüncü kişilerin fikri mülkiyet haklarını ihlal etmek.

Bu tür davranışların tespit edilmesi halinde, ilgili kullanıcının Web Sitesine veya hizmetlere erişimini sınırlandırma veya sonlandırma hakkımız saklıdır.

8. Fikri Mülkiyet Hakları

Web Sitesinde yer alan metinler, fotoğraflar, videolar, grafikler, logolar, marka unsurları, eğitim materyalleri ve diğer içerikler; aksi açıkça belirtilmedikçe Özgür Demir, Vamos Dans veya ilgili hak sahiplerine aittir.

Bu içerikler yalnızca kişisel ve eğitim amaçlı kullanım için görüntülenebilir.

Yazılı izin alınmaksızın içeriklerin ticari amaçlarla kopyalanması, çoğaltılması, yeniden yayımlanması, satılması, dağıtılması veya başka bir platformda eğitim materyali olarak kullanılması yasaktır.

Özellikle Vamos Dans tarafından hazırlanan eğitim videoları, ders içerikleri ve öğretim materyalleri, ilgili fikri mülkiyet hakları kapsamında korunmaktadır.

9. Kullanıcı Tarafından Paylaşılan İçerikler

Web Sitesi veya iletişim kanalları üzerinden tarafımıza gönderdiğiniz mesaj, fotoğraf, video, geri bildirim veya diğer içeriklerin üçüncü kişilerin haklarını ihlal etmemesinden siz sorumlusunuz.

Kullanıcı tarafından açıkça izin verilmediği sürece, özel iletişim veya kişisel içerikler pazarlama amacıyla kullanılmaz.

Kullanıcı tarafından kamuya açık şekilde paylaşılması amacıyla gönderilen veya kullanımı için açıkça izin verilen içerikler, ilgili izin kapsamında kullanılabilir.

10. Hizmet İçeriği ve Sonuçlar

Vamos Dans tarafından sunulan dersler, videolar, makaleler ve diğer eğitim içerikleri genel eğitim ve kişisel gelişim amacı taşır.

Tango eğitiminde elde edilen sonuçlar; kişinin deneyimine, fiziksel özelliklerine, pratiğine, devamlılığına ve diğer kişisel faktörlere göre değişebilir.

Bu nedenle belirli bir teknik seviyeye, performansa veya sonuca ulaşılacağı garanti edilmez.

11. Fiziksel Aktivite ve Güvenlik

Argentine Tango fiziksel hareket ve dans içeren bir aktivitedir.

Kullanıcı, kendi fiziksel sınırlarını ve kapasitesini dikkate alarak hareket etmekten sorumludur.

Herhangi bir sağlık veya fiziksel kısıtlamanız varsa, uygun olup olmadığını değerlendirmek için gerekli profesyonel görüşü almanız önerilir.

Bu madde, tüketici veya kullanıcıların kanundan doğan zorunlu haklarını ve hizmet sağlayıcının kanuni sorumluluklarını ortadan kaldırmaz.

12. Üçüncü Taraf Hizmetleri ve Bağlantılar

Web Sitesi, ödeme sistemleri, video platformları, harita servisleri, sosyal medya platformları veya diğer üçüncü taraf hizmetlerine bağlantılar içerebilir.

13. İptal ve İade

Hizmetlerin iptal edilmesi, yeniden planlanması ve ücret iadesine ilişkin koşullar Geri Ödeme ve İptal Politikası ile ilgili hizmetin özel kayıt koşullarında belirtilir.

Tüketicilerin yürürlükteki mevzuattan doğan zorunlu hakları saklıdır.

14. Sorumluluğun Sınırları

Vamos Dans, Web Sitesinin veya online hizmetlerin teknik olarak her zaman kesintisiz veya hatasız çalışacağını garanti etmez.

İnternet bağlantısı, üçüncü taraf platformlar, teknik altyapı, doğal olaylar veya kontrolümüz dışındaki diğer nedenlerden kaynaklanan kesintiler meydana gelebilir.

Ancak bu madde, yürürlükteki mevzuat uyarınca tüketiciye karşı sahip olduğumuz ve sınırlandırılması hukuken mümkün olmayan sorumlulukları ortadan kaldırmaz.

17. Uygulanacak Hukuk ve Uyuşmazlıklar

Bu Şartlar, Türkiye Cumhuriyeti hukukuna tabidir.

Tüketici işlemlerinden doğan uyuşmazlıklarda, tüketicilerin yürürlükteki mevzuat kapsamında sahip olduğu başvuru ve yasal haklar saklıdır.

Tüketici Hakem Heyetleri ve tüketici mahkemelerine ilişkin yetki ve başvuru kuralları, uyuşmazlığın niteliğine ve yürürlükteki mevzuata göre uygulanır.

18. Yasal Hakların Saklı Tutulması

Bu Şartlarda yer alan hiçbir hüküm, tüketicilerin veya kullanıcıların yürürlükteki mevzuattan doğan ve sözleşme ile ortadan kaldırılamayan haklarını sınırlandırmayı amaçlamaz.

Herhangi bir hükmün geçersiz veya uygulanamaz hale gelmesi, diğer hükümlerin geçerliliğini etkilemez.

1. Parties and Scope

These Terms and Conditions (“Terms”) govern the use of the vamosdans.com website (“Website”) and the services provided through the Website by Özgür Demir (“Vamos Dans”, “we”, “us” or “our”) to any person visiting the Website or using our services (“User”, “you” or “your”).

The services offered through the Website may include Argentine Tango group classes, private lessons, online private lessons, workshops, events, and other tango-related educational programs, retreats, marathons and services that may be offered in the future.

By using the Website, making a reservation or purchasing a service, you acknowledge that you have read and accepted these Terms.

2. Services

Vamos Dans provides Argentine Tango education and event services through the Website and/or through the physical or online channels specified on the Website.

The content, date, duration, location, instructor, capacity and price of each service are specified on the relevant service, booking or information page.

Vamos Dans may make reasonable changes to class, workshop or event schedules when necessary. Where significant changes occur, participants will be informed in advance whenever reasonably possible.

3. Reservations and Registration

When making a reservation or registration, you agree to provide accurate, current and complete information.

Completion of a reservation is subject to the applicable terms and payment conditions of the relevant service.

Where a service has limited capacity, registration may only become confirmed once the reservation and any required payment have been completed.

Vamos Dans reserves the right, in accordance with applicable law and the nature of the service, to decline a reservation for capacity, organizational or other legitimate reasons.

4. Fees and Payments

The applicable price, payment terms and any applicable taxes for each service will be clearly displayed during the reservation or purchase process.

Payments are processed through the payment methods made available on the Website or specified for the relevant service.

If the price of a service changes, previously completed and confirmed reservations will be subject to the price and terms communicated at the time of the reservation.

You are responsible for ensuring that the billing and payment information you provide is accurate.

5. Participation in Classes, Workshops and Events

You are responsible for attending the class, workshop or event for which you have registered at the scheduled date and time.

If you arrive late, fail to attend, or do not use your reservation without providing the required notice, the service may not be eligible for rescheduling or refund, depending on the nature of the service and the applicable booking conditions.

6. Online Lessons

Online private lessons are conducted live through the platform or communication method specified at the time of booking.

You are responsible for having a suitable internet connection, device, camera, microphone and other technical equipment necessary to participate in the lesson.

If you are unable to attend an online lesson due to technical issues on your side, the applicable conditions will be determined according to the service's booking terms and our Refund and Cancellation Policy.

7. User Conduct

When using the Website or Vamos Dans services, you agree to comply with all applicable laws and respect the rights of others.

You must not:

use the Website for unlawful purposes;
collect or use another person's personal information without authorization;
interfere with the security or technical operation of the Website;
transmit viruses, malware or other harmful code;

Argentine Tango involves physical movement and dance activity.

You are responsible for taking your own physical limitations and capabilities into account when participating in our classes, lessons, workshops or events.

If you have any health or physical limitations, you are encouraged to obtain appropriate professional advice regarding your participation.

Nothing in this section is intended to exclude or limit any mandatory legal rights or liabilities that cannot legally be excluded or limited.

12. Third-Party Services and Links

The Website may contain links to or integrations with third-party services, including payment providers, video platforms, mapping services and social media platforms.

Your use of such third-party services is subject to their respective terms and privacy policies.

Vamos Dans is not responsible for the content, security or practices of third-party websites or services that are outside our control.

Rules concerning Consumer Arbitration Committees and consumer courts, including applicable jurisdiction and application requirements, shall apply according to the nature of the dispute and the legislation in force at the relevant time.
